Go ahead. 12 13 Shervanick: Thank you, sir. Commissioners, on August 27th I addressed you at a case 14 number, a nd I want to repeat this so that it's in the record , case number 15 24CS05000064. I t had to do with a plat for Royal Crossing development. 16 In the subsequent meeting in September on page 22 of the minutes, you 17 accepted my words concerning that the parcel next to this parcel which 18 wishes to have multi housing has a heliport SUP ability on it, but that has 19 not been built. Based on the FFA and other organizations putting a housing 20 complex in a very small area would not be a wise decision . So I'm asking 21 this body to speak with staff concerning the SUP which is presently for the 22 hospital, but unbuilt, and now removed from this body's ability to give in the 23 Realize Las Cruces zoning change that they remove the SUP from the 24 hospital and so that the complex for the City of Las Cruces can apply for 25 low income tax credit of 9% allowing for multifamily housing at the Apodaca 26 Park Blueprint area, which is in the third place at this particular time for the 27 ability to have a 9% interest rate. On December 2nd, the City of Las Cruces, 28 at a City Council meeting, made a video concerning these properties and 29 the ability to house people in Las Cruces, which was what Realize Las 30 Cruces is all about. So this December 2nd City Council meeting at the video 31 tape two hours, 12 minutes, and six seconds to 21 minutes and 20 seconds 32 allows you to understand about the ability to house people in the City of Las 33 Cruces. Remove the SUP which is now not being used and is not allowable 34 under Realize Las Cruces. Thank you very much. 35 36 Kaiser: Thank you. NEW BUSINESS 15 16 7.2 Case 24ZO1000121: A request for approval of a Special Use Permit (SUP) to 17 allow a cannabis-based business less than the required 300 -foot buffer distance 18 from another cannabis -based business. The subject property encompasses 19 approximately 0.278 acres in size, is within the Downtown Development Code 20 Special Overlay Zone with a zoning designation of DDC -MS (Downtown 21 Development Code–Main Street) and is located at 300 N. Main Street , Submitted 22 by Tozi Botanicals LLC., representative. Council District 1. 23 24 Kaiser: All right. Moving on to new business. Our first item this evening is 7.1 a 25 request for special use permit to allow a cannabis based business less than 26 the required 300 foot buffer . And I believe this is located in the downtown 27 development code 300 North Main Street . I will turn it over to staff for a 28 presentation. 29 30 Castillo: Good evening, Commission. Tonight, we have a special use permit request 31 for a cannabis micro business located at 300 North Main Street. The current 32 conditions of the property is it's located within our Downtown Overlay Zone 33 with a sub zoning designation, or zoning designation of DDC -MS, which is 34 our Downtown Development Code-Main Street. As said before the property 35 is located at 300 North Main Street at the intersection of Main Street and 36 Las Cruces. And the property is approximately 0.27 acres in size. This 37 area has been operating as a shopping center with various commercial 38 businesses. There used to be a restaurant, and there's a few offices, some 39 retail businesses, those kinds of things . So the proposed use , it doesn't, 40 isn't out of context with the surrounding neighborhood. As you can see here 41 it's a zoning map that shows the subject property highlighted and that it's 42 within our DDC-MS. 43 44 Here's an aerial image of the subject property . So today, the applicant is 45 proposing a special use permit or SUP to manufacture cannabis based 46 Page 6 of 14 5 products at a small scale. And the reason this is coming forward is because 1 it will utilize a commercial kitchen of an already existing cannabis based 2 business. The proposed business will conduct its business during 3 nonoperational hours of the existing cannabis business known as The 4 Kitchen. The reasoning that it comes to us before an SUP is because it 5 does not meet the buffer distance from one micro business to another , or 6 one cannabis based business to another cannabis based business . 7 However, it does meet the buffer distance between single-family zoning 8 districts as well as any school or daycares that are within the area. 9 10 They also will follow all CLC and State of New Mexico regulations governing 11 cannabis related activity. As we can see from here in the images, this would 12 be the outside looking on Las Cruces Street. Here we can see going down 13 North Main Street . This is going to be The Kitchen which is a current 14 cannabis retail and manufacturing business . So in the off hours of The 15 Kitchen the new proposed business will come in and utilize the commercial 16 kitchen to make their cannabis products. Those cannabis products will be 17 wholesale, s ome will go to The Kitchen, and some will go to other cannabis 18 retailers throughout the City. The other image is looking through the 19 courtyard of the little plaza area. 20 21 So here I have the subject property highlighted. This is an approximation. 22 It could be a little bit bigger or smaller, but this is roughly where the suite is 23 going to be located. So all public notice and input was given to all reviewing 24 staff. Reviewing staff had no comments regarding the proposed 25 establishment. Notice was sent to all surrounding properties within 500 feet. 26 Staff did receive one e-mail with concerns for safety and hours of operation 27 because of safety reasons that would be in the area as to why they're 28 worried with the new business coming in. 29 30 Today staff does recommend approval based on the following findings, the 31 subject property meets the distance separation requirements from any 32 school, daycare, school or daycare or nursery and single-family residential 33 district. The subject parcel as it exists is surrounded by commercial land 34 uses of similar context. And meets the purpose and intent of Section 38-2 35 of the Zoning Code. They will also meet all requirements outlined in the 36 zoning code, and those stipulated by the State of New Mexico will be 37 followed. It also meets the intent and purpose of Elevate Las Cruces 's 38 Comprehensive Plan as it's located within our downtown place type, and it's 39 adjacent to two mixed use corridors to the north of the downtown and south 40 of downtown. So today, your options are to vote "yes" to approve, vote "no" 41 to deny, vote to amend, or vote to table. 42 43 Kaiser: Thank you. Any questions from the Commission? 44 45 Page 7 of 14 Smith: No. I just, I guess a quick question . So basically you know the new 1 business is just sharing space with the old business basically doing the 2 same thing, producing the same type of products. 3 4 Castillo: Mr. Chair, Commissioner Smith. That is correct. 5 6 Je. Acosta: Mr. Chair. Q uick question for you . So he's requesting a SUP however, 7 currently it doesn't meet the standard of the buffer, correct, as it stands? 8 9 Castillo: Mr. Chair Commissioner Acosta. That is correct . It doesn't meet the 300 10 foot distance requirement between cannabis businesses. 11 12 Je. Acosta: Thank you. 13 14 Smith: And this cannabis business is basically the one in the same building. S o I 15 understand how it doesn't meet the requirement for the buffer, but the 16 business that they're requesting the variance for is open and receptive to 17 them coming in and establishing their business also, correct. 18 19 Castillo: Mr. Chair, Commissioner Smith. That is correct. 20 21 Ochoa: Pardon me. Thank you, John. Adam Ochoa, Community Development, for 22 the record. To clarify for you Commissioner Acosta. Correct, so they don't 23 meet the distance requirement at 300 feet from a cannabis related business, 24 a.k.a. the micro business from another cannabis micro business . But 25 through the special use permitting process the Planning and Zoning 26 Commission has the ability to approve the business to go in there to not 27 meet a 300 foot distance, based on the Commission's belief that if there's 28 any negative impact on the area, if there's any potential issues, any health, 29 welfare, and safety issues that might be brought up to the Commission at 30 the meeting as well . So that's kind of why we're here for the special use 31 permitting. 32 33 Je. Acosta: Okay. This doesn't swim, I vote one way or another but I'm going to ask the 34 question. If one of the Commissioners up here does not want to approve 35 the SUP, what conditions can we put , because we have to give a reason 36 why we would not want to move forward to approve it. What can we state? 37 Can we state because it does not meet the required buffer setback, and 38 would it be valid for us? Maybe that's a question for legal? 39 40 Ochoa: Mr. Chair, Commissioner Acosta. Whatever you deem is an appropriate 41 finding that is what you need . So currently before you have findings for 42 approval, so if you are going to vote to deny, if you feel that you know that 43 you feel it should meet the minimum 300 foot distance requirement , y ou 44 know if you feel that there's potentially some type of issues with two 45 businesses going in the same location, whatever it is you feel could be a 46 Page 8 of 14 7 finding is how you would state your vote for denial, and then state those 1 findings essentially. 2 3 Je. Acosta: Thank you. 4 5 Kaiser: So this business, if I understand correctly, is wholesale , t here's no retail 6 component out of this location. 7 8 Castillo: Mr. Chair. That is correct. It would be wholesale retail. That would be the 9 only component to it. 10 11 Kaiser: Okay. So they wouldn't have, they wouldn't have customers coming in in 12 these hours of operation once the other businesses wrapped up for the day? 13 14 Castillo: Mr. Chair. The subject property 4 encompasses approximately 144.78 acres, is zoned PUD (Planned Unit 5 Development) and located with the Metro Verde PUD area. The subdivision 6 proposes 416 single-family residential lots that will be developed in 8 phases along 7 with all the required roadways that provide access to the subdivision and a park 8 that will be dedicated to the City. Submitted by Sierra Norte Development, Inc. 9 Council District 5. 10 11 Kaiser: All right, m oving on to item 7.2, this is a request for approval of a planned 12 unit development at Red Hawk Estates. And I will turn it over to staff for 13 presentation. 14 15 Ochoa: All righty. G ood evening again Commission. T his is a proposed planned 16 unit development, special use permit for final site … I'm sorry. I'll start over 17 again. Final site plan, my apologies, still remembering the one from before. 18 For a final site plan planned unit development final site plan known as Red 19 Hawk Estates Phase 3. Subject property is located what would be the 20 northern extension of what is Voyager Street and Eagle Vista Street, kind 21 of located on the east and west side of those streets surrounding what is 22 the existing Red Hawk G olf course. The subject property encompasses 23 roughly about 144 acres , 145 acres in size . It is currently vacant or 24 undeveloped land. This area is associated with the Metro Verde PUD or 25 planned unit development. A nd it's currently zoned with that PUD sub 26 zoning of U3 which is sub urban. Trying to give you a better idea. This is 27 really right up there at the most, the farthest northern City limits of the City 28 of Las Cruces. All this right here is on PUD. It is what is the Metro Verde 29 Planned Unit Development area. You can s ee here as well . Everything 30 that's highlighted in yellow is the proposed final site plan surrounding what 31 is the existing golf course around here, the golf club itself down here to the 32 south. Voyager as I explained before will be extended from the south all 33 the way to the north along the most western portion of this. And Eagle Vista 34 right over here being extended into it as well to give you an idea where we're 35 at. 36 37 So this is a final site plan that is proposed in eight separate phases, which 38 will bring in approximately 416 single-family residential lots. There will also 39 be one additional lot, roughly about two acres in size, will be dedicated to 40 the City and utilized as a park. Access for this subdivision area will be via 41 the extension, as I stated before of Voyager Street. Eagle Vista Street and 42 the easternmost of the extension which would be a new street, Luna Vista 43 Street as well. Lots within this subdivision range in size between 0.16 acres 44 in size and 0.77 acres, so very wide range of lots, from your standard lot to 45 more of an estate lot. 46 Page 10 of 14 9 1 Here is kind of a picture of the actual final site plan itself, where the 2 residential homes running along those residential streets here . A larger 3 intersection street here with a trail, because there is that large transmission 4 line going through there, so that will be built as well. The proposed park will 5 be here. That extension of Eagle Vista. And as you can see each phase 6 has been labeled and colored schemes where you can see where those 7 phases will be kind of counterclockwise going into development. 8 9 So once staff did their analysis, we really didn't identify any really life, safety, 10 or welfare issues. Additionally, on top of that per the 2001 Zoning Code, 11 specifically Section 38-48d.d1 it essentially states that while a concept plan 12 is required to provide all these findings as to why we could approve one , a 13 final site plan it just simply states it must follow what is approved with the 14 original concept plan. So in this case, staff does feel that the Red H awk 15 Estates Phase 3 final site plan conforms with Metro Verde PUD concept 16 plan. Additionally, the proposed roadways are consistent both with the 17 Metro Verde PUD, with their cross sections and their design, and with City 18 design standards as well . It is located within the suburban neighborhood 19 place type. And it is providing that, as I stated before, like a diversity. They 20 are all single-family homes, but a large variety of income and ability to 21 develop those lots . Notice was sent to all; reviews were sent out to all 22 relevant agencies and departments and all did recommend to approve and 23 supported the proposed final site plan . Notice was also sent out to all 24 surrounding property owners per the 2001 Zoning Code notification 25 requirements. And staff received no public input for the proposed 26 subdivision. 27 28 This was reviewed by the Development Review Committee, which reviews 29 subdivisions from an infrastructure, utilities , and improvement standpoint. 30 And on November 20, 2024 after a very minor discussion of the final site 31 plan, the DRC did recommend approval for the proposed subdivision. With 32 that staff does recommend approval for the final site plan based on the 33 findings shown here. The final site plan conforms with what is the approved 34 concept plan of Metro Verde. I t is part of the development that balances 35 benefits for the community and the developer at once as well. Based upon 36 staff's analysis it meets the intent of Elevate Las Cruces Comprehensive 37 Plan, and fulfills the purpose and intent of Las Cruces Municipal Code, 38 section 2-382. Additionally, the DRC did do a recommend of approval for 39 the final site plan during public meeting on November 20, 2024 . With that 40 your options, o ne to vote "yes" and vote to approve the proposed final site 41 plan as recommended by staff . Two to vote "no" or deny. A reminder, if 42 you do vote to deny you will have to provide new findings of fact that you 43 either discuss or come up with by yourself . Three to vote to amend. Four 44 table or postpone and direct staff accordingly. That is the conclusion of my 45 Page 11 of 14 10 presentation. The applicant is here, if you have any questions for them. So that is additional 9 connectivity between the PUD. So there are multiple areas here where it 10 intersects with the golf course that they will be building those roadways 11 through there, sir. 12 13 Kaiser: Okay. Thank you. It 10 was a pretty busy year, but we got through it. So definitely appreciate all 11 you all's times to commitment to being on the Planning and Zoning 12 Commission. Did want to remind you all, I don't know if you noticed, but we 13 e-mailed everything this time around for your case packets. And the reason 14 for that is we kind of wanted you to get used to it because starting January 15 we are moving to what is the iCompass software, where if you've seen the 16 City Councils the way their agenda is created and how links are attached to 17 that PDFs and so forth like that, we're going that exact same route . So 18 everything will be digital. There will be a whole new agenda. It'll have that 19 little excerpt for us explaining how the acceptance of the agenda will work . 20 So but everything is kind of because of that and additionally staff having to 21 do staff reports, e verything will be coming out a lot earlier. That being said 22 though if there's anything that comes out that's in the staff reports, whether 23 it's a pretty decent sized final site plan like we saw tonight, or anything else 24 that might come up in the future that you would like a hard copy for , staff 25 will be more than happy to still print a hard copy of anything that you would 26 need for that and actually deliver it to you if need be . So just wanted to 27 clarify that starting next year that is the route we're going instead of just a 28 bunch of attachments of PDFs, there will be a link .
